Changing employer while holding an EU Blue Card in Austria must be handled as a new residence procedure during the first year. The card initially authorises employment with the employer named in the application.

The change therefore requires a change-of-purpose application for a new EU Blue Card. If the change occurs before twelve months, the new employment can generally be taken up provisionally only after a 30-day period. That period runs only when the documents needed for the assessment have been submitted in full.

After at least twelve months of employment in Austria on the basis of the EU Blue Card, this waiting period no longer applies. The labour market test otherwise required by the AMS also falls away. This special rule must be distinguished from the mere passage of a calendar year and from short employment under another residence title.

Prove the employment period first

Arrange the existing card, employment contracts, payslips and insurance records chronologically. To apply the twelve-month rule, it must be clear how long the employment in Austria was based on the EU Blue Card.

Understand the employer restriction and new application

The EU Blue Card initially relates to employment with the employer named in the application. It is therefore not a general authorisation to take any job in Austria. The new position must be assessed independently against the EU Blue Card requirements.

During the first year, a planned change is not a simple notification of a new employer. It requires a change-of-purpose application for a new EU Blue Card. Section 20d AuslBG governs the procedure involving the AMS. The general notification rule in section 26 NAG does not replace the specific employer-change rules in section 20d AuslBG.

Section 20d(2b) AuslBG, introduced by amendment BGBl. I No. 81/2026, contains a general 45-day rule for certain residence titles tied to a particular employer. That period must not be transferred to the EU Blue Card: its specific rule in section 20d(2a) AuslBG provides for 30 days and a special rule after twelve months.

Change before twelve months: 30 days and full documents

A person who has used the EU Blue Card in Austria for the former employment for less than twelve months must submit the change-of-purpose application for the new position. Under the official Austrian rule, the new employment may be taken up provisionally after a 30-day waiting period from filing the application.

The period runs on the condition that the documents required for the assessment have been submitted in full. If the new employer declaration, detailed duties profile or another necessary document is missing, the 30-day period may be suspended. The filing date alone therefore does not prove that the new employment may safely begin.

Provisional employment after the period has run does not replace the decision on the new EU Blue Card. It provides a statutory option for the interim period. The application, documents, receipt and actual start date should therefore form one consistent record.

After twelve months, the change becomes easier

A person who has already been employed in Austria for at least twelve months on the basis of the EU Blue Card is not subject to a waiting period when changing employer. The new employment may begin immediately after the relevant application, provided the other requirements and the complete application situation support that step.

The labour market test otherwise required by the AMS also falls away in this situation. This does not mean that the new position is exempt from review. The duties, qualification, remuneration, employer and remaining EU Blue Card requirements remain part of the procedure under section 20d AuslBG.

The twelve-month rule concerns employment in Austria on the basis of the EU Blue Card. A year of residence, a period under another title or a period without the relevant employment cannot automatically be treated as equivalent.

Prepare the new position and documents completely

The new employer declaration must describe the actual employment. It should state the employer, role, duties, place of work, working time, contract term and gross remuneration. The information should match the new employment contract and detailed duties profile.

The connection between the position and the qualification remains important. Changing employer does not remove the requirement for highly qualified employment that corresponds to the qualification relied upon. A regulated profession may also require Austrian authorisation to practise.

The personal file should include the existing card, the decision granting it, the former employment contract and evidence of the beginning and duration of the employment. Add the new contract, employer declaration and evidence arising from the new position. The change-of-purpose checklist helps organise the procedural documents.

Document the period, application and start date

For planning purposes, record three dates separately: the end or change of the former employment, the filing of the change-of-purpose application and the planned start with the new employer. An immediate contractual start cannot override the residence rules.

Before twelve months, calculate the 30-day period only after confirming that the application package was submitted in full. Keep the receipt and the submitted documents together. If documents are added later, record every submission date because missing evidence can affect the period.

After twelve months, the basis for dispensing with the waiting period should be provable. The card, relevant employment start and connection to EU Blue Card employment are particularly important. Interruptions or a change of title require a separate assessment.

Avoid common mistakes when changing employer

A frequent mistake is starting work for the new employer before the application has been filed and the relevant period has run. This is especially important before twelve months. The contractual wish to start does not replace the residence assessment.

An incomplete application package creates another risk. If the contract describes the job differently from the employer declaration or the remuneration is unclear, the authority cannot assess the new employment on a clear basis. The 30-day period should not be treated as complete prematurely.

Finally, the twelve-month rule is sometimes confused with simply holding the card. The relevant factor is employment in Austria on the basis of the EU Blue Card. The card, granting decision and employment records should establish that point together.
