Marriage, divorce or an administrative name change alters the identity data printed on a residence permit card. Section 8(2) NAG requires permits to contain in particular name, given name, date of birth, photograph, authority and validity. The card is an identity document. Different names in passport and card are therefore not merely cosmetic.

Section 19(11) NAG contains the central duty: changes to the identity data must be reported to the authority promptly. On application, the document is reissued with original validity and scope and with corrected identity data where required. A name change is therefore generally a reissue rather than an automatic new grant application.

Two levels still need separation. First comes spelling and production of the new card. Second, divorce can affect the residence basis of a family-based permit. A work or long-term permit produces a different starting point from settlement derived directly from marriage.

Apply for reissue with the original validity

Section 19(11) NAG requires prompt notification of changed identity data. On application, the document is reissued with corrected data where necessary and with its original validity and scope.

Coordinate passport and card sequence

A residence permit card is an identity document showing the name. The new identity should be established by suitable civil-status and identity records. Which document comes first depends on the issuing state and the NAG authority requirements.

Establish one official spelling

Differences in diacritics, double names or transliteration can trigger questions. The identity shown by official records is central. Every alternative spelling needs a documented bridge.

Review the name and family-based status separately

The new card corrects identity data. Divorce may additionally affect the basis of a family-based permit. An independent settlement right or another permit route depends on the exact permit and statutory conditions.

The visible card label does not always show the full legal basis. The decision, renewal file and family status show whether only reissue or an additional residence assessment is needed.

Notification under section 19(11) NAG

The provision covers loss, unusability and changes to the identity data underlying a residence document. Each event must be reported promptly to the NAG authority. A name change concerns the data used to produce the existing card.

A bare message without records may not be enough. The authority needs to identify the person, the old name on the card and the official basis for the new name.

Reissue rather than an automatic new permit

On application the document is reissued with original validity and scope. The new card does not extend the permit merely because the name changed and does not enlarge labour-market rights.

If the permit will expire soon, reissue and renewal may overlap. Determine whether an replacement card alone or a renewal application is also necessary. The procedures have different conditions and timing.

Civil-status record and passport

After marriage, the marriage record is typical proof of the chosen name. After divorce, the final divorce decision and a declaration or register entry returning to an earlier name may be relevant. Divorce does not always change the name automatically.

The passport is usually issued by the state of nationality. Its naming law and procedure determine when a new passport is available. The Austrian NAG authority needs reliable identity evidence for card production.

If the passport still has the old name, coordinate sequence with both authorities. An expiring passport can also affect practical use and document validity.

Spelling, transliteration and double names

Names from other scripts can be transliterated in different ways. Hyphens, spaces, diacritics and multiple surnames can also vary between registers.

Use an officially evidenced spelling aligned across the core documents. A translation should not invent a form that does not appear in the passport.

Earlier names remain traceable through records. A short chain lists old name, legal event, date and new name. This helps where employment, tenancy or insurance records still use the old name.

Marriage does not automatically change permit purpose

A person holding a permit for work, study or long-term residence does not automatically move to a family permit on marriage. The immediate issue is correction of identity data.

A simultaneous change to a family permit is a separate change-of-purpose or grant process. A name record does not replace housing, insurance, means or proof of family status.

Divorce and a family-based permit

Divorce changes the name only if the applicable naming law and required declaration produce that result. Separately, assess whether marriage was the basis of the permit. The card and decision show the starting point.

Section 27 NAG may be relevant to an independent settlement right where the family basis ends. Conditions and exceptions cannot be inferred simply from the length of the marriage.

Everyday records and registers

After production of the new card, social insurance, employer, bank, tenancy records and other bodies need to connect the new name to the person. The sequence depends on whether each body requires the new passport or card.

Old records are not retrospectively false but need a clear link through the name-change document. Use the file number in every notification during pending NAG proceedings.

For travel, ticket, passport and residence card should match in practice. While names differ, carry the change record and an understandable translation.

Practical document package for reissue

The core package includes current residence card, passport, official name-change record, translation and any apostille or legalisation. Registration, photograph and the latest grant or renewal decision can also help.

After divorce, evidence that the decision is final should be available. Returning to an earlier name requires the corresponding record. Multiple nationalities can create different passport stages.
