Changing schools with a residence permit: purpose and authority
Changing schools with an Austrian residence permit: purpose, new training, evidence, authority and extension under the NAG.
2 September 2026
Proceedings
Mag. Mirela Saric, Attorney at Law
Changing schools is not only an educational decision for a minor who holds an Austrian residence permit. The key questions are which residence title the person holds and whether the new school or training arrangement is still covered by the existing purpose of stay.
Moving from one school to another may be treated differently from moving into an apprenticeship, workplace-based training or employment. The title Residence Permit Student is linked to legally defined forms of education. The new admission therefore needs to be compared with the existing residence title before the change takes place.
This article explains which documents the authority needs, when a change of purpose under section 26 NAG may be required and how to prepare an extension application under section 24 NAG in good time.
Initial orientation
Does the purpose stay the same after a school change?
This check sorts the current title, the new training arrangement and the key evidence. It does not replace review of the individual decision and admission documents.

01 Question 1
Which residence title does the minor currently hold?
All paths at a glance
Overview of all answers.
01
The school change is prepared for review against the title and the new training arrangement.
Arrange the current residence title, the decision, the new admission confirmation, the training plan, evidence of academic progress and information on support and insurance in one consistent timeline.
02
The school change cannot be classified safely without the exact residence title.
Read the title on the card and the last decision. The title, its purpose and any conditions are decisive. Only then can the new school or training arrangement be classified reliably.
03
The new training arrangement must be settled before the change.
Obtain a specific admission or training offer. A general intention to start an apprenticeship or another training arrangement later is not enough to assess the residence purpose.
04
The new training arrangement may trigger a change of residence purpose.
Notify the authority in Austria without delay of an intended change of purpose and check which residence title is required for the new training. The requirements for the new title must be met independently.
05
The purpose must be clarified from the actual training arrangement.
Compare the existing purpose with the timetable, training plan, contract and work component of the new activity. The label of the training alone does not decide whether the existing title is sufficient.
06
The authority needs the new training and its timeline in verifiable form.
Add the admission confirmation, start and end, training type, hours, academic progress and evidence of means of support and health insurance. Resolve contradictions between the documents before filing.
Why changing schools can affect a residence title
A residence permit is not granted independently of its purpose. For a Residence Permit Student under section 63 NAG, the person must continue attending a school or training arrangement covered by the statute. Section 63(1) NAG includes, among other things, public schools, private schools with public status, certain statutory schools, certified non-school educational institutions and specific nursing and social-care training programmes.
A change within the same legal category must therefore be distinguished from a move into an apprenticeship or training that is substantially workplace-based. The new institution should be described not only by name, but also by its legal status, curriculum and actual timetable.
Moving to another public school or a private school with public status may in principle remain within the existing educational purpose. The new school must meet the statutory requirements and confirm admission in writing. For a private school, the information on public status deserves particular attention.
Even a seemingly simple school change should not be reported to the authority in an unexplained one-line message. Useful documents include an admission confirmation stating the school type, level, start and expected end, together with a short explanation of why the former school is being left. The explanation need not be extensive, but it should make the timeline understandable.
Academic progress remains relevant for an ongoing permit. Section 63(3) NAG generally requires evidence of academic progress for an extension. The new school therefore does not remove the need to document the progress achieved in the previous arrangement.
When an apprenticeship can require a new purpose
An apprenticeship or training with a substantial workplace component is not automatically covered by the student purpose. The exact training form, the balance between school and workplace time, any remuneration and the employment-law position must be assessed. Calling something training does not answer the question by itself.
Section 26 NAG applies if the purpose of stay is to be changed. Anyone wishing to change the purpose during their stay in Austria must notify the authority in Austria without delay. A change of purpose is permitted only if the requirements for the requested residence title are met and an available quota place is required and available.
The refusal of the new title does not automatically affect the existing right of residence under section 26 NAG. This does not mean that the new training may be started without further review. Before the change, the existing title, the requested new title and employment law should be examined together. The overview of changing the purpose of a residence permit explains the general route.
Which evidence the authority needs
The authority must be able to see which title exists and what is actually changing. The core file should therefore contain the residence card, the last decision, the new school's or provider's admission confirmation, a training plan or timetable and the start, duration and intended qualification.
For minors, evidence of care and the actual living arrangement should also be kept current. This article does not address custody law. For the residence assessment, however, it remains important who provides care and education and whether the new confirmation matches the existing file.
Depending on the title and procedural stage, evidence of means of support, accommodation and health insurance may be needed. For an extension under section 24 NAG, the academic progress of a Residence Permit Student is particularly important. The first residence permit application checklist can help organise general documents, but it does not replace the title-specific evidence for a school change.
How extensions and deadlines fit together
Under section 24(1) NAG, an extension application must be filed with the locally competent authority in Austria before the residence title expires and no earlier than three months before that date. After a timely application, the applicant remains lawfully resident in Austria until a final decision is made.
Until the decision is issued, an application to change the purpose or the residence title may be combined with the extension application. Section 24(4) NAG also provides that the existing title with the same purpose may be extended if the requirements for the requested new purpose are not met but the requirements for the existing purpose still remain satisfied.
In practical terms, a school change should not be reported only shortly before the card expires. The admission confirmation, academic progress and funding evidence should be available early enough to resolve uncertainties with the school, family and authority.
How to prepare the authority process
The locally competent residence authority is generally responsible. The file should start with a short letter identifying the existing title, the planned change, the date of the new admission and the requested next step. Every attachment should be named and ordered consistently.
If the authority requests additional information, the answer should be factual and complete. A short statement without an admission confirmation or training plan leaves the central question unanswered. A well-organised file, by contrast, can show that only the school has changed and that the purpose of stay remains the same.
If the file is complex, inspection of the NAG file may help first. It shows which information and evidence are already available and what the authority's question is based on.
Frequently asked questions about changing schools
Must every school change be reported when a person holds a residence permit?
A school change should at least be reported and documented with the new admission confirmation where the title expressly depends on schooling or the change takes place shortly before an extension. Whether a formal change of purpose is required depends on the new school and the actual training arrangement.
Does a Residence Permit Student remain valid for every new school?
No. Section 63 NAG covers specific schools and training arrangements. Another public school or recognised private school may serve the same purpose. An apprenticeship or training with a substantial employment component requires checking whether another residence title and a change of purpose are needed.
What must be checked when changing to an apprenticeship?
An apprenticeship is not automatically covered by the student purpose. The training plan, workplace periods, remuneration and employment-law basis must be assessed. The appropriate residence title under section 26 NAG should be clarified before the apprenticeship begins.
Which documents should the family prepare?
Important documents are the residence card, the last decision, the new school's or provider's admission confirmation, start and duration, a training plan or timetable, academic progress and current evidence of support and health insurance. For minors, care and living arrangements should also be kept current.
Can the change be combined with an extension application?
Yes. Under section 24(4) NAG, an application to change the purpose or residence title may be combined with a timely extension application until the decision is issued. The requirements for the new title must still be met independently.
