Student mobility to Austria: which university submits the notification, which evidence is required and how the 30-day objection period works.

Third-country nationals who hold a valid study residence permit in an EU Member State may move to Austria for part of their studies. EU student mobility requires a Union or multilateral programme with mobility measures or an agreement between the participating higher education institutions. The study period in Austria may last up to 360 days per Member State.

Before the move, the two higher education institutions and the student must establish whether the planned period falls within these rules. A notification may already be arranged when the application is filed in the first Member State. If the stay in Austria is agreed later, the relevant authority must be informed as soon as the intention becomes known.

This article explains the requirements, the role of the higher education institutions, the relevant documents and the 30-day period for objections. Secure the early notification and Austrian study period

The mobility was already planned when the first Member State application was filed. Check that the notification reached Austria and that the student permit covers the entire period. Keep the programme, university agreement, admission confirmation and travel document together.

Document the later notification for the study period

If the mobility became specific only after admission in the first Member State, the notification must be made once the Austrian stay is known. Organise the university agreement, Austrian admission, period and valid student permit in a clear file. The objection period runs after the complete notification is received.

Prepare the notification before mobility begins

Before studies begin in Austria, the notification and evidence should be complete. The valid travel document and the first Member State student permit are required. Depending on the procedure, the programme or agreement, admission, period, insurance, funding, study fees and an Austrian address may also be requested.

The Austrian higher education institution must be identified as the second Member State institution and as the place of the study period. Clarify the programme, admission, start and end dates and the connection with the programme or agreement. The notification can then be filed with a reliable set of evidence.

EU student mobility requires a valid study permit from the first Member State. If that basis is missing, the appropriate Austrian residence permit for the planned studies must be assessed. The name of a mobility programme alone cannot establish the short mobility route.

An Austrian student permit or another residence permit addresses a different question from mobility from the first Member State. Establish whether the plan is a regular Austrian study programme or a temporary study period. The regular route has its own admission and evidence requirements.

Requirements for student mobility to Austria

The starting point is a valid study residence permit issued by the first Member State. The student must take part in a Union or multilateral programme with mobility measures or be covered by an agreement between two or more higher education institutions. Only part of the studies is completed at an institution in the second Member State, Austria.

The stay may last up to 360 days per Member State. This limit describes the mobility entitlement for the relevant second Member State. It still requires careful planning: the first Member State permit must cover the full period, and the travel dates must match the study period.

If there is no mobility programme or agreement between higher education institutions, the special route does not arise. An application under the general admission rules for study and residence in Austria must then be assessed. The regular Austrian student permit follows a different structure from a temporary study exchange under EU mobility rules.

Which university must confirm the admission?

The Austrian higher education institution is the place where the study period takes place. Its admission confirmation should state which studies or courses will be attended, when the period begins and ends and how it fits into the existing programme. A general reference to an exchange often leaves important practical questions open.

The connection between the institutions may arise from a Union or multilateral programme or from an agreement between two or more higher education institutions. The documents should show which institution in the first Member State supports the existing student permit and which Austrian institution provides the second study period.

The hosting agreement for researchers concerns a different group. It nevertheless illustrates an important documentation principle: purpose, institution, period and funding must fit together across the relevant documents. For students, the specific admission and study arrangement are decisive.

Notification: timing and required information

The second Member State may require notification of the intention to complete part of the studies there. The notification may come from the higher education institution in the first Member State, the Austrian institution or the student. The important point is that the competent authorities receive the mobility information in a timely and traceable way.

If the Austrian study period was already planned when the first Member State application was filed, the notification is made at that early stage. If the mobility becomes specific only after admission, it is notified as soon as the intention regarding Austria becomes known. The date should be supported by the document that records the mobility decision.

The notification should identify Austria, the Austrian institution, the programme or university agreement and the planned study period. It must be accompanied by the valid student permit and travel document. The transmission route and the responsible Austrian authority should be clarified before travel.

Evidence and the 30-day objection period

The notification must include the valid travel document and the valid residence permit issued by the first Member State. The permit must cover the entire mobility period. If it expires earlier, the evidence does not establish the planned study period as a whole.

Austria may also request proof that the student completes part of the studies under the programme or university agreement and has been admitted by the Austrian institution. The duration and dates, health insurance, sufficient means for living costs, study costs and return travel and, where relevant, paid study fees may also be requested. An Austrian address may have to be provided before the mobility begins.

The second Member State may object within 30 days after receiving the complete notification. The period is linked to complete receipt. Keep the transmission proof, list of attachments and any request for further evidence together. Objections may concern missing conditions or documents, an applicable refusal ground or the maximum period already being reached.

Starting the stay and changing the study plan

If the mobility was notified with the first Member State application and the second Member State raises no objection, the student may use the mobility during the validity of the residence permit. For a later notification, the start depends on the absence of written objections within the applicable examination period.

A change of Austrian institution, study programme or dates should be clarified with the relevant institutions before travel or before the new study period begins. The original notification documents only the arrangement described there. A material change may require a new notification or a different residence assessment.

Anyone who wants to remain in Austria for a longer period or continue the studies here permanently should keep the mobility route separate from a regular student permit. Purpose, duration and admission must be reassessed. Extending an exchange period does not automatically create a right to remain.

Assess family members and employment separately

Student mobility concerns the person holding the study permit and the defined study period. Family members do not automatically receive the same residence position. Their own permit, family relationship and the rules of the first and second Member States must be assessed separately.

Employment follows its own labour and residence rules. Taking a part-time job does not extend the student mobility entitlement and does not replace any required employment authorisation. The residence purpose remains the documented study period.

A sound assessment therefore records the student permit, higher education documents, mobility period and any additional residence or employment plans separately. This prevents a study exchange from being confused with a new main purpose of residence.
