A trip that extends beyond the expiry date of the current residence permit card requires its own return plan. Under section 24(1) NAG, a person remains lawfully resident after a timely renewal application until a final decision. The same provision provides a separate confirmation in the travel document for re-entry.
The renewal application must be filed with the competent authority in Austria before the current title expires. In principle, filing is possible no earlier than three months before the expiry date. A merely scheduled appointment does not have the same significance as an application that has actually been filed in time.

Secure the application and expiry date first

The renewal application must be filed in time before travel
Section 24(1) NAG requires the renewal application to be filed with the locally competent authority in Austria before the validity of the current residence title expires. In principle, filing is possible no earlier than three months before the expiry date.
Three dates therefore matter for travel planning: the expiry date of the current card, the date on which the application was actually filed and the planned return. Documents can be organised earlier. The legal effect of the renewal procedure is linked to timely filing.
The official information on renewal applications explains that the application must be filed in Austria with the settlement authority competent for the applicant's place of residence. Check the authority and keep proof of receipt before leaving.
Lawful residence and re-entry are separate questions
After a timely renewal application, section 24(1) NAG provides that the applicant remains lawfully resident in Austria until a final decision, subject to the provisions of the FPG. This rule describes residence in Austria while the procedure is pending.
A trip beyond the expiry date also requires a document for the return. Section 24(1) NAG therefore provides for a confirmation in the travel document on a reasoned request. Lawful residence and documented entry permission have different functions.
Plan the issues in this order: timely filing and jurisdiction first, then the confirmation, its validity period and the route. This keeps clear which document addresses which part of the journey.
The confirmation in the travel document requires a reasoned request
Under section 24(1) NAG, a confirmation of timely filing may be attached to the foreign national's travel document on a reasoned request. The authority may issue it for no more than three months. The request should make the reason for travel, the planned period and the intended return understandable.
The confirmation entitles the holder to visa-free entry into Austria under the Act. The official government information commonly calls it a Notvignette and explains that it may also support entry into the Schengen area for onward travel to Austria. It does not replace a new residence title and does not extend the old card.
Before departure, clarify whether the confirmation has actually been attached, which travel document it covers and when it expires. General information about a pending procedure does not answer those questions.
The travel document, route and return date must fit together
For the return, consider the valid travel document, confirmation, expiry date of the old card and planned border crossing together. The confirmation must relate to the travel document used for the journey.
The route may create additional transit or border questions. This is especially relevant for transfers and entry through another Schengen state. Before booking, check the requirements of the route, the travel document and the border authorities involved.
The return date should fall within the period covered by the confirmation. If the itinerary changes, compare the new period again with the confirmation and the authority documents.
Organise these documents before departure
Keep a copy of the renewal application filed in time and its confirmation of receipt. Add the travel document, the current residence permit card and the confirmation in the travel document once it has been attached.
Authority letters, appointment details and requests for additional documents belong in the same file. A chronological record shows which statement or document has already been submitted and which response is still open.
Save the itinerary, return date and a reliable contact detail as well. If the trip changes, this makes it easier to check whether the confirmation still covers the new period.
A late application is a separate legal situation
If the application is filed only after the residence title has expired, it is generally treated as a first application. Section 24(2) NAG permits treatment as a renewal application only if an unforeseen or unavoidable event prevented timely filing and the applicant was not at fault or was affected only by a minor degree of carelessness.
The application must also be filed within two weeks after the obstacle has ceased. The reason for the obstacle and the date on which it ended should be supported with concrete documents.
This rule for late filing does not replace travel planning based on a timely renewal application. Anyone planning a trip beyond expiry should clarify the filing and the confirmation in the travel document before departure.
